Teen accused in fatal Papa John’s shooting arraigned in separate incident

COLUMBIA, Tenn. (WKRN) – A teen accused of killing a Papa John’s employee during a 2014 robbery was arraigned on several charges Monday stemming from another incident in 2015.

Darious Fitzpatrick was arraigned on charges of misdemeanor assault, vandalism of property $500- $1,000, aggravated assault, escape and attempt to commit escape.

The charges are in connection to a January 2015 incident unrelated to the fatal robbery. He pled not guilty via video and was also appointed a new attorney, Mike Harris of Lawrenceburg.

In the October 2014 murder of 22-year-old Papa John’s employee Gordon Schaffer, Fitzpatrick will be tried as an adult and faces charges of first degree murder, felony murder and especially aggravated robbery.

The teen’s Monday appearance was also supposed to be a settlement discussion on the murder charge, but the court appointed another attorney.

Schaffer was shot to death after two black men, one allegedly Fitzpatrick, entered the Papa John’s on Shady Brook Court to rob the business.

The victim was the only person inside the store at the time and was shot despite complying with the robbers’ demands. He died later that night.

The next date for settlement discussions is now October 13.

A new trial date has not been set.
