Undocumented Murfreesboro Man Allegedly Sexually Assaults Child

MURFREESBORO, Tenn. (Jen French) — When it comes to the border and the criminal justice system, the line can be blurry.

Murfreesboro Police arrested 37-year-old Juan Carlos Martinez for allegedly sexually assaulting a 9-year-old girl. According to a police report, Martinez is undocumented.

Immigration attorney Elliott Ozment said undocumented people, just like legal citizens, have the right to due process. If an undocumented person is convicted, Ozment said he or she should serve the time in the country where the crime was committed.

“Shutting off all immigration is not going to solve the crime problem,” Ozment said. “We don’t want a person to commit a serious crime and then just get deported and escape the prison sentence to which that person is entitled if he’s guilty of that crime.”

Murfreesboro Police said Martinez confessed to sexually assaulting the girl. In a report, police said Martinez did not have any legal documentation. Martinez works in construction and lists his birthplace as Mexico.

Former State Representative Joe Carr spearheaded many immigration laws during his term.

“And in the years of 2013 and 2014, there were 66,000 illegal alien criminals that were released back into the United States,” Carr said.

Immigration and Customs Enforcement spokesperson Bryan Cox tells FOX 17 that undocumented people cannot be deported unless they’re convicted of a crime.

“They don’t pay the price if they’re arrested and they’re deported immediately,” Ozment said.
Carr believes illegal immigrants accused of crimes should be deported.

“Barak Obama’s executive order is basically granting amnesty to millions of illegal immigrants who are here,” Carr said.
