Judge denies plaintiff request in UT rape lawsuit

KNOXVILLE, Tenn. (WATE) – A judge has denied a woman’s request for a temporary restraining order in a lawsuit against the University of Tennessee, claiming the school violated Title IX and created an environment that enabled sexual assaults by student athletes.

On Tuesday, U.S. District Judge Aleta Trauge denied the plaintiff’s motion, saying she knew about the hearing for some time but chose to file the motion after business hours on a Friday before a three-day holiday weekend.

Monday was a holiday for federal offices. Judge Trauge said the plaintiff’s attorney did not follow the Federal Rule of Civil Procedure.

The plaintiff is expected to be at a hearing that could take place on Wednesday.
